Terms Of Sale
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Shipping Policy for further information.
In order to contract with PARADIGM CLOTHING, you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. PARADIGM CLOTHING retains the right to refuse any request made by you.

Our Contract
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until we have conducted any verification (see 5.C.1 below) that may be necessary for your order, your payment has been approved by us and we have debited your credit or debit card.

Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies, or out-of-date information regarding pricing, shipping, payment terms, or return policies.

Verification Process
For security purposes, we may require additional verification or information to enable us to complete your order. We may ask you to supply the following information:
A copy of your photographic driver’s license or passport; AND
A copy of a utility bill showing your name and address; AND
A copy of the credit card used for the purchase showing the name and address on the card and the last four digits of the credit card number.
We may then contact you via your email address or phone number to verify your order.

Payment
Upon receiving your order we carry out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorization check has been completed. Your card will be debited once the order has been accepted.

If you purchase any of our goods or services through our website, you agree to pay us the applicable fees and taxes as set out in the confirmation of your order. If you fail to pay us the applicable fees or taxes as agreed, we reserve the right to cancel your order.

Delivery
You will be given an indication of the expected delivery time when you place your order online. PARADIGM CLOTHING insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by PARADIGM CLOTHING and transfer of responsibility in the same way. Please note that we aim to dispatch all orders within 48 hours. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. We are not responsible for any delays caused by destination customs clearance processes. If your order does not arrive by the expected delivery date, please contact us as soon as possible so we can follow up with the carrier.

Returns & Refunds
You have the right to return your order within 14 days of the receipt of your goods. You must inform us in writing within 14 days of the receipt of your goods of your intention to return the goods. Returned goods must be unused and in their original packaging with any labels still attached. You are responsible for the cost of returning the goods to us, unless the goods are faulty or were incorrectly supplied by us.

Once the goods are received by us, we will inspect the goods and notify you of the approval or rejection of your refund. If your refund is approved, we will process the refund within 7 days of the approval. We will refund the price of the goods in full, including the cost of delivery to you (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

Limitation of Liability
To the maximum extent permitted by law, PARADIGM CLOTHING shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any other damages of any kind, including but not limited to loss of profits, revenue, savings, data, or use, incurred by you or any third party, whether in an action in contract or tort (including negligence) or arising out of or in connection with your access to, or use of, the Service or any content provided on or through the Service.

Indemnity
You agree to indemnify, defend, and hold harmless PARADIGM CLOTHING, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages, and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of the Terms of Service.

Variation
PARADIGM CLOTHING shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

Complaints
We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise. Please let us know if you have any complaints or comments.

Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Governing Law And Jurisdiction
These terms and conditions are to be construed in accordance with the laws of Victoria, Australia and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of Victoria, Australia.

Entire Agreement
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and PARADIGM CLOTHING. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of PARADIGM CLOTHING.
